Every GOP candidate for The US House or Senate, who is not polling at least 60% - your ship has arrived, and it is filled to the brim with electoral gold.

The 2008 session of the United States Supreme Court has brought us a judicial coup in progress. They have been lurching toward this for at least 40 years, since the Warren Court, and now they have openly and brazenly inserted themselves ABOVE the Constitution and ABOVE the elected branches of our Constitutional republic.

Four months before an election in which the Republican chances in Congress are universally considered bleak, SCOTUS has ruled on a matter outside their jurisdiction, given civilian court rights to terrorists, and invalidated a death penalty law by citing 'evolving standards' and European courts.

It's a gift from Heaven.

But please indulge me for a second. I'm feeling some rage that I have to deal with, so excuse the sidebar.

You hate the American Constitution, you hate conservatism and conservatives, and I hate you. You have continually violated your oath, which makes you loathesome and shameful creatures, utterly unworthy of the high office you've been assigned. Now you Congressmen and prospective Congressmen. Whatever you were running on before (which was hopefully in the ballpark of 'make the tax cuts permanent', win in Iraq, fix social security, tort lawsuit reform, federalism, AGW is a lefty hoax, and the like), by all means continue on those themes.

But now your banner headline issue is this: The supreme courts defied the constitution and illegally placed itself over the two elected branches of government. They have made a mockery of the Constitution and threaten to rewrite the
Constitution and the laws in their image. They are clearly engaging in a power grab and using their power to advance left-wing political ideals by freeing terrorists and eliminating capital punishment. Our 220-year Great Experiment is at stake -- the situation is no less grave than that.

My Democrat opponent loves what they've done and supports them. If (re-)elected, I pledge here and now to file or join in filing Articles of Impeachment against 5 justices: kennedy, breyer, stephens, ginsburg, and souter.

Do it. Do it now. And win, baby, win! Then when you win, fulfill that promise, and help rescue America from the mullhcracy that now has its boot on our neck.

As I said earlier, these 5 justices have become the embodiment of the left wing zealots in flowing sanctimony that Justice Clarence Thomas, (whose name will always deserve capitalization, as he is the finest member of our Court, and was my vote to become Supreme Court Justice over Roberts) warned us about. These 5 traitors ought to be thrown out on their liberal nanny ***es especially Kennedy, who has far and wide betrayed the man who put him on the Court. This decision has me fuming to the point where I've actually been pacing. As a parent, this is the angriest I've ever been at our government especially one that values the rights of rapists over the rights of my child. There's a special hot hot hot place for Kennedy and the monsters he seeks to protect.

You look at this latest ruling and it enrages you. Well, you'd better buckle your seatbelt, because if Che Obama gets elected, this will be a walk in the park. He will pack the court with justices that make john paul stevens look like a radical right-winger.

Anyone who's entertaining sitting out or supporting The Leftist should just take a gander at this and decide if this is the direction they'd like to see the USA go...because it's just a teaser trailer for an Obamessiah presidency.

IMHO, impeachment for violating Art 3 Sct 2 would be a hugely educational exercise in Constitutional civics - something high school students could study for generations, in how the separation of powers doctrine played out perfectly when one branch usurped its power and the other 2 branches slapped it down.

But actually what I am advocating here is simply a winning electoral tactic.

I zoomed you a couple weeks ago....so I guess payback's a B***h.
I was just coming online to layout the outrageous ruling on a States right to decide when and under what circumstances to apply the Death Penalty and renew my call from a week ago for each person at Red State to write their Congressmen and Senators and ask them to file a sense of the House and/or Senate resolution that if the scotus refuses to return to our Constitutional form of government and continues to insert itself into issues that are the purview of States, the POTUS and the legislative branches of government that Articles of impeachment will be filed in the House of Representatives with a trial and conviction to follow in the Senate to end their criminal and treasonous usurpations of Power in order to return this nation to a government of, by and for the PEOPLE!

Dispatch Kennedy from the Court and many problems are resolved.

I don't have any great love for the "liberals" on the Court - but in most cases their opinions are comprehensible, at least attempt to formulate a legal justification and rationale for the outcome they have selected, and are generally known quantities.

Kennedy is a total enigma - his decision in one case (even one handed down today), has no bearing or predictive value for how he will vote in another case (perhaps one coming down tomorrow). His opinions are always, to put it bluntly and a bit crudely, crap. They provide no logic, no reasoning, and nothing that even resembles a traditionally-valid legal basis for the outcome. Any opinion written by Kennedy is full of fluff, is typically based on totally irrelevant issues, principles, or documents and is so sweepingly vague that just about anything can be justified within its terms.

At least if there are going to be 5 liberal votes on the Court, let them be 5 votes that can actually provide an opinion that doesn't make experienced lawyers scratch their head and wonder what exactly they just said.

Kennedy is what happens when a president is forced to go to his third choice (remember, Kennedy's seat is the one for which Bork was denied and the DC Circuit's Ginsburg withdrew from - after revelations of marijuana use or something like that).

The last two rulings from Kennedy would have to be multiple times better just to reach the level of abominable. If I read the phrase "evolving standards" one more time in one of his opinions, I'm going to hurl. (um, is that phrase in the Constituion right next to 'a wall of separation between church & state'?)

I guess the only thing I'd add is: Should we introduce term limits for these guys? It seems like having them for-life encourages them to misbehave.

It may also be time to openly defy some of these decisions - I know the Conservative justices wouldn't agree with that premise, but if the actions of this court are allowed to continue, the elections in November may be rendered irrelevant.

And the MSM certainly will not allow the reasonable view, that this is a grievous bad ruling, get out clearly.

When ginsburg and stevens retire, nominate conservatives to replace each. Fight for them.

Then, when the Senate rejects them, just simply let it be. A seven person Court would have a Conservative majority. I wish it would be five of seven, but four will do. Let it go until after the 2010 mid-term elections and run against an obstructionist Senate. In the meantime, let the four do their jobs.

Also, select Bobby Jindal for VP. He knows how to react quickly to provocation - and to do it in a way that will appeal to the voters. His castration bill may not stand up . . . but it has curb appeal.

I'm just curious. Can President intentionally leave a seat on SCOTUS vacant if it meant removing an unfavored justice or avoiding a contested nominating process altogether? Wouldn't that set a bad percedent if no such was set in the past?

I'm fairly certain their is a provision in which a president can appoint justice's for up to a 2 year term without congressional approval. I may be mistaken and this is far out of my area of expertise.

I think, if the president appointed someone the Senate rejected them and the President refused to appoint another, that would do it wouldn't it?

I guess there would be a problem if we were talking about a retirement because the last couple retirements stayed till their vacancy was filled

Seriously, Republicans can't even get a majority of either body and aren't likely to in the coming election; we ain't impeaching nobody. Plus, we blew it the last time we tried and gave the whole process a bad smell for most of the electorate - you know, those guys who actually vote in elections.

The issue is only good in some states and most of them are pretty firmly Red anyway. The Death Penalty is a bad issue in a lot of the Country; too much contradictory DNA evidence, too many episodes of CSI. Talk to members of the criminal bar about how hard it has become to get a guilty verdict. Sure, I appreciate the sentiment, and in the abstract, I suspect a majority of the res publica would support the death penalty for a child rapist, but when you came to the actual facts of the matter, it'd be a whole different matter. I know that if someone raped my little girl, they'd better pray to God that the cops find them before I do, but that doesn't mean that I place much trust in the judicial system to do the killing for me.

I disagree with your premise that nobody would support in in the electorate...There are significant majorities in most polls that are opposed to judicial activism and 2004 proved it to be a winner for the GOP. I suspect they're going to gut the Second Amendment today and I know that would have blue blooded red necks calling for some judicial heads to roll!

The Articles of Impeachment wouldn't even have to pass, or even come to the floor for a vote to have the necessary point...If it was proposed, and a majority of the Republicans Cosponsored it and signed onto the discharge petition the message would be sent!

As for the threat of impeachment and whether Republicans could get the votes...just because Republicans are in the minority now doesn't mean they will always be...and the Kennedy's on the court would have the possibility of a future conservative super majority throwing them out on their ear in the back of their mind every time they write an oppinion.

The one thing for sure is this....If we sit idly by and allow them to continue shredding the Constitution, that'll only be bolder the next time they have an opportunity to throw our troublesome rights away!

What we do is elect John McCain. And when a vacancy comes up we hold his feet to the fire and make sure he only appoints qualified Judges in the mold of Alito and Roberts. If he doesn't we do what we did with Miers. We make it perfectly clear that we are tired of "stealth Judges" and won't take it any more. We put as much pressure on the senate as we can to get good judges confirmed.

What we don't do is run on a platform to impeach 55% of the supreme court. This is political loser. The press would play it as a blatant power grab and make it out that Republicans are trying to create a police state without any real judicial oversight. With such an extreme move, I fear a number of these accusations would stick.

For that matter, a better strategy would be to increase the size of the court back to 11 and then appoint two conservative judges.

Calling for the impeachment of 1 supreme court justice is an extreme move, calling for the impeachment of 5 is political suicide.

Again...actually impeaching them is irrelevant...it's the threat that counts!

There are some who I'd vastly prefer to "stand by and do nothing" because the "somethings" that they want to do are misguided or just plain stupid. That said, an impeachment agenda is divisive and counterproductive, Republicans have essentially destroyed that option for a while. Elect a Republican and hold his feet to the fire on appointments. If we don't have enough votes to confirm his nominee, let the seat stay vacant and make sure he makes the DOJ be very careful about what comes up and what positions it takes. He can then use his executive powers to be "very pursuasive" with intransigent senators, e.g., do everything he can to make sure nothing good can happen in their state until they see the light. There are rarely silver bullets, political change is an incremental process unless, like the Contract in '94, sorta, you run on a particular reform agenda and come to a majority with that agenda.

JUST IN 8:15am EASTERN, SUPREME COURT UPHOLDS LOWER COURT RULING OVERTURNING DC GUN BAN!!!

Kennedy swung to the Conservatives on the Court in a 5-4 ruling upholding the lower court's ruling overturning the Washington DC gun ban.

This ruling is stunning given the recent usurpation of our rights and the purview of other branches of government!

I was predicting the court would go the other way on this...but I guess taking too much too soon was a fear of the SCOTUS

Bottom line...Gun Rights activists finally win one for the Constitution and DC Residence have a right to own handguns and defend themselves and their property!

What will Bloomberg do in NYC now? or San Fran Nan? or every liberal big city mayor across the country?

Oh...and did I mention...the Republicans in the Senate made him the "Chairman" of the judiciary committee who is the primary committee that approves the President's judicial nominees>

I guess now he's the ranking member on the Committee...so he'll be following the Dems Lead!
