Two of my recent posts here on Redstate have dealt with Supreme Court decisions that I have said will have fallout that is not yet felt. I found this excerpt via a link on the Drudge Report today and I really hate the fact that in this case they are proving me right.

WASHINGTON (Map, News) - Barack Obama's foreign policy advisers said Tuesday that Osama bin Laden, if captured, should be allowed to appeal his case to U.S. civilian courts, a privilege opposed by John McCain.

Responding to questions from The Examiner, Sen. John Kerry and former White House counterterrorism czar Richard Clarke said bin Laden would benefit from last week's Supreme Court decision giving terrorism suspects habeas corpus, the right to appeal their military detention to civilian courts.

“If he were to be brought back,” Clarke said of bin Laden, “the Supreme Court ruling holds on the right of habeas corpus.”

Kerry, who applauded the Supreme Court ruling, said it will be carried out by whichever candidate wins the presidency.

Randy Scheunemann, McCain's senior foreign policy adviser, said those rights should not be extended to bin Laden or the hundreds of terrorism suspects being held by the U.S. military at Guantanamo Bay in Cuba…

…Obama said President Bush has relied too heavily on military prosecution of terrorists, which has “given a huge boost to terrorist recruitment in countries that say, ‘Look, this is how the United States treats Muslims.’”

Now this type of thinking, and the development of further permutations are only going to continue, and it won’t be for the better. The Supreme Court Justices have placed a ball in play that the left is seizing upon, and make no mistake; they will capitalize upon the move by the justices. As more time goes by, and more arguments are to be made by the candidates, you can rest assured that they are looking for one thing and one thing only. That is, to gain the trust of the people. While these two things may not seem to be related [trust and the Court decisions] they are. The left is going to take up the position, that they are enforcing the rulings and laws that the Supreme Court has handed down. The right is going to have to take the more difficult stance, of proving them wrong, and exposing the Court for what it is and has become, a majority of hacks in my opinion, led by Kennedy himself.

The real problem is that it is always easier to gain the trust of the people, when you say you are enforcing the law, and not trying to show that the law is wrong, or the actions taken by judges/justices are out of line. I heard a quote from Tim Russert before he passed away, and others have echoed it, where he said, that the candidate who can gain the trust of the people will win this election in November. I hope that Sen. McCain steps up to the challenge here. To be honest I am not thrilled with him as a candidate, I was originally a Romney guy myself. The right must prove its argument, as I have laid it out in this post, by using a great deal of eloquence, clear solid thinking, and most of all resolve! Sen. McCain is lacking in some of those areas [even if they are on the surface] where as Obama is not. The left has a clear agenda here and so do the justices of the Court. In this case they happen to be coinciding; the ultimate goal to keep the republicans out of the White House in November.

There were a few comments made on my posts which discussed the difficulties of impeaching the Justices. The points made were valid ones, and the process of impeachment would be (hopefully will be) very difficult. Yet exposing the decisions of the Supreme Court for what they are, unconstitutional, is more important now then ever.
