In 1998, Patrick Kennedy was convicted by a jury of his peers and sentenced to death for the rape and mutilation of his eight-year-old step-daughter.

The sentence of capital punishment was handed down by a local judge, based on a constitutional provision passed by the popularly elected Louisiana State Assembly.

The sentence was upheld by a 5-2 vote in the Louisiana Supreme Court.

On June 25, 2008, based on his own personal opinion, Justice Anthony Kennedy decided that he was smarter than a jury, 6 judges, and, according to one USA Today article, the state laws of Louisiana, Georgia, Texas, Montana, Oklahoma and South Carolina, which all allow capital punishment in cases involving child rape.

The hour is late and seven stern-faced individuals clad in fine, dark suits under black overcoats walk into a dimly-lit room and take their assigned seats at a round table. As they come together to confer and decide a question with severe ramifications that will influence the lives of millions of Americans nationwide, the atmosphere is anything but amicable.

Although the above scenario perhaps resembles a scene from the Francis Ford Coppola film The Godfather, the individuals in question are not crime lords, but rather the seven justices of the California Supreme Court, and the issue at stake is the constitutionality of a California statute banning homosexual marriage. Just over a month ago, the California Supreme Court defied over 4.6 million voters by overturning a California statute banning homosexual marriage. Two weeks ago, the same court—in what has been called one of the most egregious cases of judicial activism in modern American history—refused a petition for Stay and Rehearing of the May 15 decision.

The fight for the unborn remains front and center in the national political debate. Congress recently debated the Mexico City Policy in the House Foreign Affairs Committee and once again discussed whether to provide federal funds to organizations that promote abortion. In addition, Planned Parenthood in suburban Kansas City has a pending 107 indictment before a grand jury for performing unlawful late-term abortions and other unconscionable acts.

In this current climate of hostility toward life and particularly the unborn, Republican and Democratic Members alike who cherish life must let our voices be heard that we will protect and defend the innocent and most defenseless among us.

Mr. Speaker, 21 years ago in the fall of 1986, I found myself sitting on the couch in my medical office in rural south Georgia.

My wife, Niki, and I had been married a year and we were struggling. I had been through several broken marriages, several episodes of broken relationships and financial problems because I had been living for myself. I'd been living a prideful, sinful, self-centered lifestyle.

The Christmas catalogues are arriving in the mail. Forget the post-Thanksgiving rush. Holiday shopping has already begun – and begins earlier each year -- thanks to the World Wide Web.

But if the Democratic Congress has its way, consumers could pay up to 17 percent more to shop online if the federal ban on the state and local taxes on Internet sales is allowed to expire on Nov. 1.

For years, Republican leaders have pushed for a permanent ban on taxing sales on the Internet – something I firmly support. Instead, Congress continues to argue about proposals that would continue a short-term ban on state and local governments from levying taxes on web sales.

Governor Eliot Spitzer has recently decided to authorize thousands of illegal aliens to obtain driver's licenses in the state of New York. Amazingly, under Governor Spitzers new policy, beginning in 2008 applicants for drivers licenses will no longer be required to provide a Social Security card or to show legal status. Foreign passports, a previous state driver s license, and foreign birth certificates will all be considered acceptable proof of identification in New York.

Many states have recently added requirements to prevent illegal aliens and would-be terrorists from obtaining driver's licenses, as required under the REAL ID Act of 2005. Under this law, states are required to insist on a Social Security number in order to get a license by the end of 2009. Instead of making it harder to obtain a license, Governor Spitzer has chosen to ignore the REAL ID Act by reversing rules that New York had previously established requiring a Social Security card.

While Governor Spitzer's actions might score political points with the more than 500,000 illegal aliens in New York, his decision is a threat to national security. Many of the terrorists who committed the attacks on September 11th were here illegally and easily obtained driver's licenses and state IDs as identification. The licenses allowed the terrorists to open bank accounts and to blend in without raising suspicion. Potential terrorists will once again be able to easily obtain the documentation they need. It is inconceivable to me that the Governor of the state that saw the greatest loss of life on September 11th would make such a reckless decision.
