Fake Rape case prosecutor calls for parental rescue

The state attorney general's office agreed Saturday to take over the sexual assault case against three Duke University lacrosse players at the request of the embattled district attorney.
Durham County District Attorney Mike Nifong, hamstrung by a flip- flopping witness and dogged by allegations that he made inflammatory statements to the media [Note: And withheld evidence, but why mention that? It damages the white-on-black racist violence template], asked Attorney General Roy Cooper's office Friday to appoint a special prosecutor.
Quoth the Associated Press:
Facing ethics charges that could lead to his disbarment, the embattled district attorney in the Duke lacrosse sexual assault case has asked the state attorney general to appoint a special prosecutor to take over the case.
That part is true, as is this:
Last month, the North Carolina State Bar charged Nifong with violating four rules of professional conduct for making misleading and inflammatory comments about the athletes under suspicion. The ethics charges carry penalties ranging from admonishment to removal from the bar.
The part that just may not be (besides Nifong's case itself)? The following:
Nifong's attorney insisted the veteran prosecutor was not running from a weak case and said Nifong was disappointed he would not take it to trial.
Actually, I believe that second clause - Nifong has been chomping at the bit for many, many months now to get those three boys to trial, and has shown that he'll use any story that the accuser decides to believe on any given day day to do that.
As his attorney said, "[Nifong] still believes in the case. He just believes his continued presence would hurt her."
Well, duh.

Nifong would be perp-walked out of his office in leg-irons with a coat over his head.

The biggest losers in the end will be the Durham taxpayers who will end up having to dish out a hefty sum of money to these guys after they sue them to oblivion.

It has gotten tons more holes since, but there were holes before the primary-the DNA already was known to not match, and if I remember correctly the one guys alibi was already known.
Nifong essentially used that case and destroyed the lives of some students to get elected. He wanted charges and conviction more than he wanted justice, and he doesn't deserve to have a liscense and he sure enough shouldn't be in the position of prosecutor.

if this case led to some reform and oversight in the way that prosecuters conduct themselves. We're seeing too many of these bizarre witch hunts lately. Right, Mr DeLay?

The new prosecutor is going to have to get up to speed on the case and reinterview everybody. Won't that simply delay the inevitable dropping of the charges?
If the guy had any class he would've dropped it himself, but it is pretty clear from his behavior that having class is the least of his problems.

The DNA evidence (lack of any lacrosse player DNA, but multiple other DNA contributers present not from the Lacrosse team) not only means it is hard to prosecute the rape, but it also impeaches the victims statements.
I think the main area of investigation this may lead is to a charge against the victim for filing a false report and all that.
I doubt it takes long to decide to drop all charges, even if you had a suspicion the guys were guilty of something, there isn't a case to prosecute, the defense will eat the victim alive with her multiple statments and story changes, and they can do it kindly and gently and still burn her testimony to ashes.

This case smelled from the beginning, but what made it worse was the Duke women making it a national story by picketing the men's house and demanding their ouster from campus. The coach lost his job that seemed to have been his for life. The families are paying tens of thousands for attorneys and the only ones traumatized are the men. Someone said that Nifong won reelection by the "inellectuals." Give me a break, he won in a landslide and that area is not so heavily skewed in the "intellectual" population. If "rednecks" saw through the baseless charges, then they failed to vote otherwise Nifong would be tossed.
Prediction: a new prosecutor will review the charges and dismiss all counts. I only hesitate on this because the state AG does not seem to want to handle this from his own office. As I understand it, he has this option and need not appoint a special prosecutor. If so, why is he passing the buck? If someone knows more about the NC process please pass on the info.

Their reputations, their jobs, and their lives before the nightmare are another case.
And even worse some employers ask about being charged and/or indicted for crimes, not neccessarily convictions, so those three guys are going to have to put yes and "rape" on those applications. They may never get their names back, and employment opportunities may be gone forever.
Mr Nifong and the 88 proffessors should be ashamed of themselves. Nifong may be held accountable to some degree, but the proffessors on the Duke campus will get to just say "oops" if they say that at all.
If you read my post carefully you will note that nowhere do I claim that the despicable Nifong won the election in the manner you cite, nor do I imply it. The title or heading of my post, I would have thought, was the key.
If the post needs explanation, I guess it does, it is a slap at the pretentious, smug, and bigoted class briefly described. One needn't be a faculty member to fit that description, one need only be a liberal.
As to "redneck", a term chosen only to capture the disdain the above class views anyone unfortunate enough to disagree with them. One term among many but one should suffice. Consequently I pose no electoral divisions between classes and address only the arrogance that blinds both decency and judgement.
You put two words in quote marks, rednecks, which I think I have covered, and intellectuals. The last was spelled "inellectuals", fully capable as I am of spelling or typo errors yet I hope that error is not assigned to me.

According to the AP, Nifong said ... "he wants to make sure the accuser receives a fair trial."
Did this guy study the Constitution? Or maybe it's just me. I thought the accused was entitled to a fair trial.
