The 9th Circuit Court and Communism Compared

I read with interest Erik's great piece on the 9th Circuit Court of Appleals decsision of Fields vs. The Palmdale School Discrict. The court said the following:
We also hold that parents have no due process or privacy right to override the determinations of public schools as to the information to which their children will be exposed while enrolled as students.
Does this sound a little familiar? I thought so and I did some research on the Theory of Communism. In their Book: The ABC of Communism, Bukharin and Preobrazhensky have a chapter totally devoted to Communism and Education. They state the following "in regards to preparation for school life":
In bourgeois society, the child is regarded as the property of its parents - if not wholly, at least to a major degree. When parents say, 'My daughter', 'My son', the words do not simply imply the existence of a parental relationship, they also give expression to the parents' view that they have a right to educate their own children. From the socialist outlook, no such right exists. The individual human being does not belong to himself, but to society, to the human race. The individual can only live and thrive owing to the existence of society. The child, therefore, belongs to the society in which it lives, and thanks to which it came into being - and this society is something wider than the 'society' of its own parents. To society, likewise, belongs the primary and basic right of educating children.
If the Ninth Circuit Court of Appleals is to be believed then we are essentially turning our countries children into wards of the state. Does this sound familiar?
According to Marx, communism is a process which will eventually develop into a full utopia. I guess the Ninth Circuit is doing its best to begin this process of collectivism of the state. I am not sure the judges really understood the scope of their ruling but I guess they really do believe "It takes a Village to Raise a Child"
Socialism in its purest form has proven to be a miserable failure. Look at the supposed success stories. (See North Korea and Cuba)

That is what our public school system is.
Should an individual parent be allowed to dictate what should and should not be taught in school? What if a parent didn't want their child being taught foreign languages? Should they be able to sue the school system in order to force their child not be taught foreign languages?
Our public school system is a communal educational system. Communities determine what they want all children to be taught and then set the curriculum to adhere to that. If an individual parent doesn't like that they have other opportunities.
On diary entries that throw around the word "communism."
I agree with the social position that schools should stay out of these sorts of topics.
At the same time, how did the 9th circuit court err constitutionall? I'm pretty sure the constitution is silent on the specific issue and unless the state of California has specific laws related to restricting this sort of information to parents, then how was the court supposed to side with the plaintiffs absent some legal foundation?

The damage being done in the 9th circus is appalling. I'm always weary anytime someone say's "it all for the children". seems to me when a group of people start to push extreme philosophies they always start by saying "it all for the children". Russia, Poland, Germany, and the list goes on and on.
