Senator Pryor's announcement that he will vote against Alito's confirmation, along with Senator Conrad's announcement that "he is leaning toward voting for Judge Samuel Alito," and Senator Stevens finally announcing he will vote for Alito's confirmation, leaves nine senators unaccounted for:
Bayh (D - IN), Cantwell (D - WA), Chafee (R - RI), Dorgan (D - ND), Landrieu (D - LA)Lautenberg (D - NJ), Menendez (D - NJ), Rockefeller, (D - WV) and Snowe (R - ME).
Five of the nine - Chaffee, Dorgan, Landrieu, Rockefeller and Snowe - voted for the confirmation of Chief Judge Roberts. Judge Alito might still receive sixty votes for confirmation.

IIRC, Bayh introduced Roberts and then voted against him.
I don't think theres any question as to how Bayh will vote. He just has to look like he's contemplating it because his state is conservative. When he's at home giving interviews he tries to pull off the I'm a conservative-moderate Democrat. But when he gets back to Washington his voting record says otherwise.
It's hard to avoid the conclusion that these remaining nine are waiting out the cloture vote. Which, by the way, DiFi reversed herself on this afternoon.
I had earlier predicted a 63-37 final vote on the nomination - but I've got to say I was surprised and disappointed by Lieberman (again), and a little surprised by Nelson of FL. Guess he thinks he doesn't have to worry about Katherine Harris. Wish we could make him regret that.
Wait! Maybe the whole Harris "campaign" is another brilliant Karl Rove rope-a-dope: to sucker Nelson into pandering to the Kossack base, then swoop in with the "real" GOP candidate who will clean his clock in the general, now that he's let it all hang out.
Anyway, 61 or 62 still wouldn't surprise me - assuming Chafee and Snowe hold, which I think is reasonable. I'm surprised Bayh has lasted as long as he has - guess he must have caught a little heck from home on his Roberts vote, which was genuinely odd. If he voted for Alito, would he the only Dem to vote No, Yes? (Well, I guess Lautenberg is still possible for that too, but who knows what the "Weekend at Bernie's" guys who are animating him will decide to do...). Cantwell is a sure "no."
Bayh was one of 13 who voted against Condi Rice. There is NO way he is voting for Alito or cloture. By the way, how about that other great Dem moderate Dianne Feinstein? After announcing after the hearings that she saw no reason for a filibuster she comes out today and says that she'll vote for Kerry's Folly. Boy, that party is just crawling with profiles in courage.
I predict the final vote on Alito will be 61 to 38...with Senator Jeffords showing up to vote at the Washington Monument.
So much for being a centrist....
It seems like Democracts will only vote for this guy if they're up for reelection in a red state. They only care about themselves.
Bayh will follow this pattern.
Each Repub will vote for cloture....even Chafee. The Dems have 4 announced voting for Alito and they won't filibuster, and Lieberman won't filibuster either. That's 5+ GOP 55 = 60

what was i thinking!i can't believe i actually voted for this man.he slowly keeps leaning to the left more & more.i don't believe he votes his constituency,unless it's the Bloomington,Gary & Indy areas only.i'd say unfortunately he'll vote no on Alito.

Didn't Sen. Lautenberg introduce Judge Alito to the Judiciary Committee?! Though he is no doubt a lame duck (for the second time), Sen. Lautenberg cannot possibly be expected to vote against confirming Judge Alito, can he?
